Welcome to the Grail skincare app!

Please read these Terms of Service (hereinafter: "Terms") carefully, as by using the Grail skincare mobile application (hereinafter: "App") you accept the terms set out in this document.

The Terms govern the rules for using the App and the relationship between users and the operator.

Scope and purpose of the Terms

These Terms apply to the legal relationship between the operator of the App and the natural persons using the App (hereinafter: "User"). The Terms cover the use of the App, including creating a user profile, browsing products, posting reviews and comparing products.

Accepting and abiding by these Terms is a precondition for using the App.

Services provided by the App

The Grail app provides the following features to users:

Displaying information about skincare products (product name, image, ingredients, price, user ratings and reviews, product comparison).

Collecting, storing and displaying user reviews and ratings of products.

Creating a personal profile, which may include the user's skin type and other preferences regarding skincare products.

Users may only use the services for their intended purpose, in compliance with applicable law and these Terms.

Subject of the agreement

These Terms form the agreement between the app's operator, rozmy.com Kft., and the user, and set out the conditions for using the services.

The agreement comes into existence when the App is installed and used by the User, and upon the User's express acceptance of the Terms.

Creating and managing a user account

In the profile, the user can enter their skin type and other preferences to personalize recommendations.

The user is responsible for keeping their password secure.

5.1 Use of the account

The User takes full responsibility for their activities in the App. The Operator accepts no liability for misuse caused by the User.

User rights and obligations

User rights

To use the App's services for their intended purpose.

The user is entitled to browse product information and submit reviews.

The user may modify their profile or request the deletion of their account at any time.

The user has the right to request information about their personal data as set out in the privacy policy (in line with Article 15 of Regulation (EU) 2016/679 (GDPR)).

User obligations

The user must not upload offensive, unlawful or false information.

It is prohibited to unlawfully collect or publish other people's personal data.

The user is solely responsible for the reviews they post in the app.

Operator rights and obligations

The operator is entitled to update or modify the content of the app at any time.

The product information, ingredient descriptions, user reviews and other content displayed in the app are for informational purposes only and do not constitute medical, dermatological or expert advice.

The operator strives to keep the data accurate and up to date, but makes no guarantee as to its completeness, correctness or timeliness.

Any decision made while using the app is taken at the user's own risk.

The operator accepts no liability for any direct or indirect damages arising from the use of the app, except where this cannot be excluded by law, or where the damage was caused intentionally or by gross negligence.

The operator ensures the secure storage of data in line with Article 32 of the GDPR.

The operator is not liable for content posted by users and is entitled to delete it if it violates these Terms or applicable laws.

The Operator ensures the continuous operation of the App but accepts no liability for technical errors caused by circumstances outside its control.

The Operator reserves the right to suspend user accounts if the User breaches the Terms.

User content

Reviews and ratings posted by users:

Do not represent the opinion of the operator.

By posting a review, the user grants the operator a non-exclusive, revocable, royalty-free license to display it within the app.

The app processes personal data in accordance with the Privacy Policy, which covers:

Data protection

Detailed information about data processing is set out in the Privacy Policy, which is available in the App or on the Operator's website. Data processing complies with the GDPR.

Limitation of liability

The product information and reviews in the app are for informational purposes only. The operator does not guarantee their accuracy or completeness.

The operator accepts no liability for direct or indirect damages arising from the use of the app, except where caused intentionally or through gross negligence.

Termination of the agreement

The user may request the deletion of their account at any time at the following web page: https://grail.hu/en/delete-profile, or by sending a request to [email protected].

The service provider processes and carries out deletion requests within 90 days at the latest from receipt, in line with Regulation (EU) 2016/679 (GDPR) and the relevant Hungarian legislation (in particular Act CXII of 2011).

The operator is entitled to suspend or delete the user's account if the user violates these Terms.

Disputes will first be resolved amicably; if that fails, the user may turn to the competent court of jurisdiction.

Modifications

The operator reserves the right to amend the Terms and will notify users of any changes within the app. Amendments to the Terms take effect 30 days after they are published.
